Two legal questions

One: Is it ethical for a judge to give a jury his opinion of a case before they have deliberated? In particular, is it all right for a judge to say, "In my legal opinion, this person is BLANK" after the jury has heard all evidence and closing remarks, but before they have been charged by the judge to deliberate?

Two: In the same case (or any other case, really), is it fair that a person can be convicted of a crime when they cannot prove that the murdered person, stolen item or smuggled goods EVER EXISTED?

Both of these things can and do happen, as I have had the misfortune to find out. I'll provide the details in my own blog.
